Lance Armstrong鈥檚 attorneys refiled a lawsuit against the U.S. Anti-Doping Agency Tuesday, a day after his initial suit had been dismissed, and only hours after USADA issued lifetime bans to three of his former staffers. Armstrong is asking U.S. District Judge Sam Sparks to prevent his doping case from going forward on the grounds that USADA has no right to charge or sanction him, and that the agency鈥檚 procedures violate his Fifth Amendment Due Process rights. Armstrong鈥檚 initial suit was dismissed without prejudice Monday as 鈥渁 lengthy and bitter polemic against the named defendants.鈥 The judge allowed Armstrong’s legal team the option to refile an amended complaint. Armstrong is asking for a ruling by Saturday, his deadline for either accepting USADA鈥檚 sanctions or moving forward with arbitration.
